Marathi Meals on Wheels (“MMOW”) coordinates community ordering and delivery of home-style meals prepared by independent local chefs (“Chefs”). mPath Services operates the website, ordering, communications, and delivery logistics. Chefs, not MMOW, are responsible for cooking, ingredients, and food safety.

1) Who we are & how MMOW works

MMOW is an online coordination service operated by mPath Services (“we,” “us,” “our”). We are logistical and digital coordinators for independent Chefs, receive orders and payments, relay information to Chefs, and coordinate delivery to you (“Customer,” “you”). We are not a restaurant, caterer, or employer of Chefs. Each Chef is an independent contractor who controls food preparation and is solely responsible for ingredient sourcing, kitchen practices, and compliance with applicable rules.

Each Chef has an individual information section on our site with item-specific disclosures (kitchen type, preparation practices, labeling/compliance notes). Please review the Chef’s section for details that apply to that Chef’s offerings.

2) Your agreement

By using this website and placing an order, you agree to these Terms, delivery rules, policies and conditions referenced on this page, including our Privacy Policy. If you do not agree, please do not use the site.

3) Orders, pricing, & payment

• Menu & availability. Menus, prices, delivery windows, and quantities are limited and may change without notice.

• Payment. Payment is via Zelle to mmow@mpathservices.com

• Receipts. We provide a digital confirmation; Chefs may include a packing slip or label.

4) Cancellations, substitutions, & delays

• Customer cancellations. Orders are generally non-cancelable due to perishable procurement and prep. We may, at our discretion, accept cancellations if you contact us promptly and prep has not begun. (Please refer FAQs for more details.)

• Delays. Weather, traffic, and kitchen issues can cause delays. We will communicate revised ETAs as soon as we can.

5) Allergies & dietary preferences

• Disclosure. Please disclose allergies or dietary restrictions during checkout. We will relay your note to the Chef.

• No guarantees. Kitchens may process common allergens (e.g., nuts, dairy, gluten). We do not guarantee allergen-free meals and are not liable for reactions. If you have severe allergies, please do not order.

6) Food handling after delivery

For safety, refrigerate or consume meals promptly per standard food-safety guidelines. We are not responsible for issues arising from improper storage, reheating, or delays in pickup/receipt.

7) Chef responsibility & independence

Chefs are independent providers responsible for:

• Ingredient quality, accurate labeling/description, and safe preparation;

• Compliance with any applicable rules or guidelines for their operation;

• Addressing prep-related quality concerns (e.g., undercooked items, missing components).

• MMOW may assist with customer communication and credits but does not control kitchen operations.

Each independent Chef maintains an individual information section on the website that includes item-specific information and disclosures (e.g., kitchen type, preparation practices, allergen handling, and any cottage/permit status). Chefs are solely responsible for the accuracy of these disclosures; please refer to the Chef’s page before ordering and contact us with questions.

8) Quality issues & remedies

If something is wrong, contact us within 24 hours with photos/details. Remedies are at our reasonable discretion and may include: (a) a remake (if feasible), (b) a partial/full credit toward a future order, or (c) a refund in limited cases. Credits are typically our default remedy for perishable items.

9) Prohibited conduct

You agree not to misuse the site, resell meals without permission, or harass Chefs or delivery partners. We may refuse or cancel orders for any reason (e.g., safety concerns, abuse, non-payment).

10) Marketing & content

Photos and descriptions are illustrative; final presentation may vary. By sending us reviews or photos, you grant us a non-exclusive right to display them (we’ll use first name/initials unless you ask otherwise).

11) Disclaimers

To the fullest extent permitted by law:

• Services are provided “as is” and “as available.”

• We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

• We do not warrant uninterrupted or error-free operation, nor guarantee allergen-free or nutrition outcomes.

12) Limitation of liability

To the fullest extent permitted by law, our total liability for any claim related to your order or use of the site is limited to the amount you paid for the affected order (or USD $100, whichever is less). We are not liable for indirect, incidental, special, consequential, or punitive damages (including lost profits or health outcomes) arising from the meals or delivery.

13) Indemnity

You agree to indemnify and hold harmless MMOW/mPath Services from claims arising out of your misuse of the site, failure to disclose allergies, or improper storage/handling of meals after delivery.

14) Third-party services

We may use third-party tools (e.g., email, maps, analytics). Their services are governed by their own terms.

15) Changes

We may update these Terms at any time by posting a revised version with a new Effective Date. Continued use after changes means you accept the updated Terms.

16) Governing law & disputes

These Terms are governed by the laws of the State of Missouri, without regard to conflicts rules. Venue for disputes is the state or federal courts located in St. Louis County, Missouri. You and we waive any class-action procedure to the extent permitted by law.

Intellectual Property & License

All content on the Site - including text, copy, pricing displays, menus, photographs, logos, graphics, layout, design systems, forms, processes, and compilations of data (the “Content”)—is owned by mPath Services or its licensors and protected by U.S. and international IP laws. We grant you a limited, non-exclusive, non-transferable license to access the Site for personal, non-commercial use. Any reproduction, republication, distribution, display, scraping, mining, or creation of derivative works from the Content without our prior written permission is prohibited.

No Competitive Use / No Scraping

You agree not to: (a) use bots, scrapers, or similar tools to access, copy, or index the Site or its Content; (b) access the Site for the purpose of building, operating, or improving a service that is competitive with MMOW or that derives a commercial benefit from our Content, pricing, forms, or workflows; or (c) reproduce our page structures, UX flows, or copy in another service. We may suspend or block access for violations and pursue all available remedies.

Trademarks & Trade Dress

Marathi Meals on Wheels / MMOW and associated logos, look-and-feel, and trade dress are proprietary to mPath Services. You may not use our marks or any confusingly similar name, mark, or presentation without written permission.

Confidentiality & Reverse Engineering

Except for information we intentionally publish, all non-public information you obtain from us—including pricing logic, delivery routing methods, forms, scripts, vendor lists, and playbooks—is Confidential Information. You will not disclose, publish, or reverse-engineer it, nor use it for any purpose other than using the Site as intended.

Feedback Assignment

If you send us ideas, suggestions, or improvements, you grant mPath Services a perpetual, irrevocable, royalty-free license to use them without restriction or attribution.

Enforcement; Remedies

Unauthorized use of the Site or Content may cause irreparable harm. We may seek injunctive relief, monetary damages, attorneys’ fees, and any other remedies available at law or equity.

Reservation of Rights

All rights not expressly granted are reserved by mPath Services.
